9. Services and Work Performed
By booking services with Timber Services, you acknowledge and agree that:

All services performed are non-refundable once completed.

Outdoor work carries inherent weather, property conditions, and natural variability risks.

We cannot guarantee identical results in all situations (e.g., plant growth, snow removal conditions, or weather impacts).

Customers are responsible for providing safe access to work areas (e.g., clear driveways for plowing, accessible tree locations).
10. Memberships and Community Access
Participation in community memberships or forums requires respectful communication, which aligns with our Community Guidelines. We reserve the right to remove or restrict members who violate these standards.
11. Submissions
By submitting ideas, feedback, or testimonials, you grant Timber Services the right to use such content for marketing, training, or service improvement purposes without compensation unless otherwise agreed.
12. International Users
Our site is operated in Michigan, USA. If you access it outside the United States, you are responsible for compliance with your local laws.
13. Indemnification
You agree to indemnify and hold harmless Timber Services, its owners, employees, and affiliates from any claims, damages, or expenses arising from your use of the Site, your violation of these Terms, or your breach of applicable laws.
14. Dispute Resolution & Arbitration
Any disputes will be resolved through binding arbitration under the Federal Arbitration Act. Arbitration will occur in Michigan unless otherwise agreed. Both parties waive the right to a jury trial or class action.
15. Limitation of Liability
To the fullest extent permitted by law, Timber Services shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Site, services, or products. We bill bi-weekly for all service contracts unless otherwise agreed upon in a signed amendment and assess a compounding late fee of 1.5% per month (18% APR) on the outstanding balance of any overdue payment. Buyer acknowledges that this rate applies to all transactions, expressly consents to its application, and complies with local usury laws. Any invoicing disputes must be made in writing and emailed to TimberServicesMichigan@gmail.com within three (3) business days of receiving the invoice. Timber Services shall deem the invoice accepted if it does not receive a written dispute within that timeframe. However, Timber Services reserves the right to consider good-faith exceptions at its discretion. If heavy-duty equipment is required to move objects too deep for trucks, there will be an added fee to cover the actual cost of such equipment or service. Timber Service will notify the Buyer of such fee and presume the Buyer’s approval by either verbal consent or continued acceptance of services. The Contractor shall not be held liable or responsible for any accidents, injuries, or damages sustained because of services rendered, the condition of the property after services, or natural conditions, including but not limited to snow, ice, rain, sleet, mud, or slippery surfaces. If the Buyer’s property does not have proper drainage from downspouts into the sewer or below-ground containment, the Contractor shall not be held liable for any resulting icy or slippery surfaces. However, this release shall not apply to injuries or damages resulting from gross negligence or willful misconduct on the part of the Contractor or its personnel. The Contractor is not responsible for damage to the Buyer’s property during tree trimming or removal, ice or snow removal, or any other service performed, unless such damage results from gross negligence or failure to exercise reasonable care. Buyer agrees to stake off, shield, or mark curbs, lawn, driveways, and landscaped areas to help avoid accidental damage. Buyer accepts shared liability for any resulting property harm in failing to do so. By signing this agreement, the Buyer affirms that they have adequate homeowner’s, rental, or commercial property insurance in effect before the service start date. Buyer hereby waives any right to file suit against Timber Services, its personnel, subcontractors, or agents, for ordinary negligence, but retains legal rights in cases involving gross negligence or intentional harm. This contract is governed by the laws of the State of Michigan, and any disputes shall be resolved exclusively in a court of competent jurisdiction located within Macomb County, Michigan, or the county in which services are rendered, as applicable. The Contractor shall not be responsible for interruptions in service caused by Force Majeure, including but not limited to acts of God, fire, explosion, equipment failure beyond reasonable control, vandalism, storms, military or civil orders, government emergencies, insurrections, riots, strikes, wars, lockouts, pandemics (including COVID-19), or labor stoppages. Timber Services will make reasonable efforts to resume service as soon as safely possible following such an event. Surcharges may be applied to reflect documented increases in materials, supply chain costs, subcontractor rates, or equipment rentals. The Buyer will be notified of such surcharges, which will only apply if mutually agreed to in writing via email, contractual amendment, or text confirmation. If either party wishes to amend this contract, any changes must be made in writing, signed by both parties, and emailed to TimberServicesMichigan@gmail.com. Services added after signing shall be documented in a separate service agreement and will incur additional charges. The Contractor will physically inspect the Buyer’s property before services to determine the actual need. All services are provided in good faith under industry-standard safety and care protocols. By signing physically or electronically, the Buyer agrees to all terms and conditions outlined above, and acknowledges the legally binding nature of this agreement in Michigan or any other jurisdiction where Timber Services operates.
16. Termination
We may suspend or terminate your access to the Site or services at any time, without notice, if you violate these Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict-of-law principles.
18. Entire Agreement
These Terms and our Privacy Policy and Refund Policy constitute the entire agreement between you and Timber Services.
19. Amendments
We may update these Terms at any time. Your continued use of the Site after updates constitutes acceptance of the revised Terms. Please check this page periodically.
